ITA Restricted Commercial Use Policy:
Ensuring Fair, Objective, Independent Evaluations
ITA's mission is to advance the performance and reliability of
instrumentation and automation technologies used in water and wastewater
treatment facilities. ITA’s mission is designed to improve the design of,
promote the application and understanding of and assist in the selection of
instrumentation and automation technologies used for monitoring and controlling
water, wastewater and industrial treatment systems for public safety. ITA
carries out its mission by conducting charitable, educational and scientific
research and testing regarding instrumentation design, maintenance and
performance and disseminates information through its published reports.
To accomplish that mission, ITA relies on its reputation for independence,
integrity, and impartiality. ITA’s Restricted Commercial Use policy is intended
to preserve that reputation, and to protect our rights as a publisher and
ITA Published information from ITA, including our Performance Evaluation
Reports, Maintenance Benchmarking Studies and technical articles, are intended
solely for the benefit of our members, affiliates and other industry
professionals, in order to help them make informed decisions about specifying,
procuring, operating, maintaining, calibrating, and troubleshooting
instrumentation, sensors or auxiliary equipment as well as the integration of
these measurement devices into controls systems. Such information may not be
used by others in advertising or to promote a company's product or service. In
addition, this policy precludes any commercial use of any of ITA’s published
information in any form, or of the names of ITA, or any other of ITA'
publications or services, without ITA’s express written permission.
ITA will NOT grant permission to manufacturers, service providers, distributors
and other commercial interests to use other manufacturers or competitor’s
information from an ITA report to perform direct or indirect comparisons for
Unauthorized use of ITA’s material may violate multiple legal rights of ITA. All
of ITA' products are fully protected under the United States Copyright Laws, 17
U.S.C. §§ 101 et seq., and unauthorized copying of, or quoting from, ITA
materials is strictly prohibited. Advertising that deceptively or falsely
misrepresents ITA findings, or that creates confusion, infringes on our rights
under the Lanham Act, 15 U.S.C., §§1051 et seq. Such advertising may also
contravene our rights under state laws prohibiting false advertising and other
unfair trade practices. Furthermore, the use of the names or published results
of a nonprofit testing organization, such as ITA, for advertising or trade
purposes is strictly prohibited without obtaining prior written consent.
If ITA determines that this policy has been violated, it will take all steps
necessary to prevent the misuse of its names or of any of its materials,
including legal action where appropriate.
Why ITA's Commercial Use Policy is Important
At ITA, we believe that objective, impartial testing and reviews are
critically important for end-users, specifiers, operators, managers,
technicians, engineers, electricians and other professionals in the water and
wastewater industry. That is why we have a "Restricted Commercial Use Policy”
preventing the use of our name and information for any promotional or
advertising purposes. The policy helps ensure we avoid even the appearance of
endorsing a particular product or service for financial gain. The policy also
guarantees that members and affiliates have access to the full context of our
information and are not hearing about our findings through the language of

For manufacturers, service providers and other distributors, adhering to the

wastewater industry professionals that use our information products and services
recognize and support our organization because it allows them to make their own
purchasing decisions based upon expert, independent, unbiased reviews. .
Encouraging Support for the Policy
We take all appropriate steps to prevent promotional and advertising use
of our materials, our name, or our content. We carefully monitor the use of our
copyrighted material such as technical articles, test reports (performance
evaluation reports), and benchmarking studies in order to preserve our
reputation as a source of information not influenced by, or associated with,
ITA's Restricted Commercial Use Policy has been respected by manufacturers,
service providers, distributors, and other commercial interests for decades.
They agree to refrain from advertising or promotional use of our trademarks and
materials. Industry understands that if they violate our Restricted Commercial
Use Policy, it may have a serious impact on their own reputation for honesty and
integrity. Manufacturers, distributors and other businesses realize that
adhering to our Restricted Commercial Use Policy is in the best interest of
their customers, the marketplace and their own commercial enterprise.
Reporting a Violation
ITA members take this policy as seriously as we do, and we most often
learn of violations through the water and wastewater industry. Many of the water
and wastewater professionals are vigilant in reporting violations of our
Restricted Commercial Use Policy. Members can become understandably upset at any
commercial activity that threatens to damage ITA’s most precious asset - our
reputation for integrity, objectivity, and lack of bias.
